Not Safely Contained - Unapprehended Killers

Every year in the U.S., there are up to 180,000 open warrants. Not all, but many of these are for murder suspects. This definitively proves that a criminal justice system cannot, “ensure the due protection of citizens.” A criminal justice system cannot even apprehend all criminals.

Not Safely Contained - Prison Masterminds

Druglords and others that run criminal organizations from inside prison can call for evil acts, including executions. The executions can be of people inside or outside of jail. The criminal leaders call for murders and other crimes with impunity because they know the justice system can’t touch them. What will they get, a longer sentence? You think they mind? They are safe from their enemies, while able to do heinous evil. They are contained, but not *safely* contained.

Not Safe - Prison Predators

An individual is convicted of murder and rape, then serves 14 years in jail. Being released in 2016, and after this, is arrested again for another crime. Subsequently, the individual rapes, kills, and chops into pieces a prison guard. He is unrepentant and says he enjoys killing, and he will kill again. What sentence should he receive? What would Francis judge as the appropriate punishment for someone of this immense malice?

This is not theory and this is not isolated. Google 'inmates killing in jail'. Asocial and serial killers require unique handling. Pope Francis does not have the expertise to adjudicate these policy decisions.

This is, in fact, a fiction and a sentiment of utopia, not grounded in reality, nor even a useful fiction.

Because of the number and severity of crimes committed after prisoners escape, the veracity of the statement that the state can “ensure the due protection of citizens” is beyond naïve. This also is, in fact, a fiction and a sentiment of utopia, not grounded in reality, nor even a useful fiction.

Conclusion

Sentencing, or excluding a punishment, for a macabre killer is not the proper role of the Pope. Pope Francis is an inspiring speaker and author. He needs to focus on the Church and let the citizens and our elected leaders make prudential decisions like these.
